Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fly CRM website (flycrm.io), CRM platform, mobile app, dashboards, messaging workflows, and related services (collectively, the "Service"). The Service is operated from Matanzas, Chile. By using the Service, you agree to these Terms.
1. The Service
Fly CRM is a business CRM and mobile cockpit for adventure tourism operators and tandem paragliding schools. It helps authorized staff manage leads, conversations, bookings, reviews, flight-day operations, and connected automations. Fly CRM is not a consumer booking marketplace and is not intended for passenger self-service unless a specific operator enables that functionality.
2. Accounts and eligibility
- You must be at least 18 years old to use the Service.
- You must be authorized by the school or operator account you access.
- You are responsible for maintaining the confidentiality of your credentials and devices.
- You must provide accurate information and promptly update it when it changes.
3. Operator responsibility
The school or operator using Fly CRM remains responsible for its customer relationships, staff access, message content, pricing, booking promises, safety decisions, and compliance with applicable laws and platform policies. Fly CRM supports operations but does not replace professional judgment, pilot responsibility, or local safety requirements.
4. Integrations
Fly CRM may connect to third-party services authorized by the operator, including messaging providers, WhatsApp / Meta APIs, payment providers, calendars, automation tools, analytics, and CRM providers such as GoHighLevel / LeadConnector. You are responsible for complying with each third-party provider's terms and policies. Disconnecting an integration may limit or disable related Fly CRM functionality.
5. Acceptable use
You agree not to, and not to allow any third party to:
- Use the Service for any unlawful, fraudulent, abusive, or unsafe purpose.
- Send spam, unsolicited commercial communications, or content that violates WhatsApp, Meta, email-provider, payment-provider, or CRM policies.
- Upload or process data you are not authorized to use.
- Attempt to reverse-engineer, probe, bypass, overload, or disrupt the Service.
- Share accounts or grant access to unauthorized users.
- Resell or sublicense the Service without written consent.
6. Fees and billing
Paid plans, when applicable, are billed through the payment method or provider disclosed at checkout or in your agreement. Fees are non-refundable except where required by law or where we explicitly state otherwise. You authorize recurring charges until cancellation.
7. Beta features
Some features may be labeled "beta", "preview", or "experimental". These are provided "as is", may change or be removed at any time, and may not be covered by any service level commitment. The mobile app may initially be distributed through TestFlight, Google Play internal testing, or closed beta tracks.
8. Your content and data
You retain ownership of the data you submit to the Service, including contacts, messages, bookings, templates, and operational records. You grant Fly CRM a worldwide, royalty-free license to host, process, display, transmit, and back up that data solely to operate, secure, support, and improve the Service. You represent that you have the rights and permissions needed to submit and process that data.
9. Service changes and termination
You may cancel or stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create security or platform-policy risk, fail to pay applicable fees, or if required by law. Upon termination we will delete or return data within a reasonable period, subject to technical and legal retention limits.
10. Warranties and disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Fly CRM disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. Fly CRM does not guarantee uninterrupted or error-free operation, nor does it make flight safety decisions.
11. Limitation of liability
To the maximum extent permitted by law, Fly CRM's aggregate liability arising out of or related to the Service will not exceed the amount paid to Fly CRM by the operator in the twelve (12) months preceding the claim. Fly CRM will not be liable for indirect, incidental, consequential, special, or punitive damages.
12. Indemnification
You agree to indemnify and hold Fly CRM harmless from claims arising out of your misuse of the Service, violation of these Terms, violation of third-party policies, unsafe operational decisions, or processing of data without proper rights or consent.
13. Governing law
These Terms are governed by the laws of the Republic of Chile. Disputes will be resolved in the courts of Santiago de Chile, unless a mandatory consumer-protection law in your jurisdiction provides otherwise.
14. Changes
We may update these Terms. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after the effective date constitutes acceptance.
